| 目的：从委托代理角度设计新的医患交易契约形式，以期实现医疗费用合理化，解决医患关系现存的问题，推动医患关系健康发展。方法：分析医患关系，从委托代理角度设计激励、与疗效相联系的新的医患交易契约形式。结果与结论：医疗费用由医生的努力程度所决定的契约方式，契约中的医生收益价值容易量化，有利于医疗支付的标准化、规范化。引入医生激励因素，将治疗效果作为医疗费用的构成部分，可以激励医生在积极提高疗效的前提下适度选择处方用药，不开“大处方”。由作为委托人的患者与作为代理人的医生共同分担风险，实现权利与义务对等，可以更好地预防医患纠纷。 |

| Objective: To design a new form of doctor-patient contract from the point of view of principal-agent, so as to realize rationalization of medical expenses, to solve the existing problems of doctor-patient relationship, and to promote the healthy development of the doctor-patient relationship. Methods: The doctor-patient relationship was analyzed. A new form of doctor-patient contract which could introduce incentive factors and be associated with efficacy was designed from the point of view of principal-agent. Results and Conclusion: In the contract form where medical costs are determined by doctors' effort, the doctors' income in the contract is easy to quantify, which is beneficial to the normalization and standardization of medical payments. The introduction of doctor's incentives together with the treatment effect as a part of medical expenses can encourage doctors to actively improve the efficacy and select appropriate prescription drugs instead of "big prescription". Patient as a client sharing the risk with doctors as an agent can realize equality between rights and duties and to prevent medical disputes. |
