| 目的：《药品管理法》与《药品网络销售监督管理办法》(征求意见稿)规定了网络销售药品第三方平台的法律责任，结合第三方平台责任落实存在的问题，提出完善网络药品销售第三方平台责任制度的建议。方法：研究药品监管法律法规关于第三方平台的条款，分析网络药品销售模式、趋势以及第三方平台责任与义务。结果与结论：第三方平台是网络药品销售共治的重要力量，平台应积极落实相关职责并制定有效的管理措施，监管机构应建立线上线下联动机制，加大对医药电商平台的检查力度，同时推进药品监管数据向第三方平台开放，明确执业药师在网络药品销售中的作用。 |

| Objective: Pharmaceutical Administration Law and the Regulations for the Supervision and Administration of Online Drug Sales (draft) stipulate the legal responsibilities of the third-party platform for online drug sales. Considering the problems existing in the implementation of the responsibilities of the thirdparty platform, suggestions were put forward to improve the responsibility system of the third-party platform for online drug sales. Methods: The provisions of drug regulatory laws and regulations on the third-party platform were studied, and the mode and trend of online drug sales as well as the responsibilities and obligations of the third-party platform were analyzed. Results and Conclusion: The third-party platform is an important force in the co-governance of online drug sales, so platforms should actively implement relevant responsibilities and formulate effective management measures. Regulatory agencies should establish online and offline linkage mechanism, strengthen the inspection of pharmaceutical e-commerce platforms, promote the opening of drug regulatory data to the third party, and clarify the roles of licensed pharmacists in online drug sales. |
